1. Application

These are the auction terms that apply between Entrepot Trade Oy (the seller) and the buyer in all sales and purchase transactions of items put up for sale by the seller or on the seller's behalf, unless otherwise agreed. The seller reserves the right to change these auction terms. Each sale and/or purchase is governed by the auction terms in force at the time the auction ends or the date of sale. The seller requires that, by participating in the auction on huutokaupat.com, the buyer has read, understood and accepted these auction terms. By submitting a bid on an item, the buyer agrees to comply with these auction terms. If the buyer does not accept these terms, they should not place a bid.

2. Buyer's responsibility

By placing a bid the buyer commits to purchasing the item. The buyer is responsible for all bids placed using the credentials obtained from huutokaupat.com or by submitting a written offer to auctions managed by the seller. The buyer is responsible for their huutokaupat.com account credentials and for any misuse of those credentials and any costs arising from such misuse.

3. Condition of auction items and inspection

Auction items are described by the seller in good faith. Estimates are given by the seller. Items are sold in the condition and with the equipment they have at the time of the auction. The seller is not responsible for the condition of the item or its suitability for its original intended use. The item is sold "as is" in accordance with section 19 of the Sale of Goods Act. The buyer is obliged to inspect the item carefully and has no right to cancel the sale.

The buyer must inspect and familiarise themselves with the item before making a binding bid or written offer and assess the item on which the bid is based. The seller provides the opportunity to inspect the item before the auction.

4. Participation in the auction

Participation in the seller's auction takes place virtually on huutokaupat.com at the bidding time indicated in the auction notice, or by submitting a written offer to the seller: Riihontie 162, 63610 Tuuri or by email to topias.riiho@gmail.com. The written offer must show the buyer's full details and the bid price excl. VAT. The written offer must be submitted no later than 3 hours before the advertised end of the auction.

5. Acceptance/rejection of a bid

The seller reserves the right to accept or reject the highest bid, unless otherwise stated in the notice.

The seller is obliged to notify acceptance or rejection of the bid within 3 (three) working days of the auction ending.

6. Payment methods

Online bank payment. Banks: Nordea, Danske Bank, Osuuspankki, S-Pankki, Aktia, Tapiola Bank, Handelsbanken, Ålandsbanken, POP Pankki, Säästöpankki

Payment term: 2 (two) days net.

Late interest is applied in accordance with section 4, subsection 1 of the Interest Act until the purchase price has been paid in full.

7. Price

The auction price is the net price; applicable value added tax will always be added to the price unless otherwise stated.

8. Liability

Items are sold in the condition they have at the time of auction. Full responsibility for the items transfers to the highest bidder immediately when the highest bid is accepted. Items may not be moved from the seller's stated location before the purchase price has been paid in full.

The seller does not grant any warranty nor any right of exchange or return for the items sold.

9. Transfer of ownership and possession

The buyer obtains ownership and the right to dispose of the purchased property when the purchase price has been paid in full.

10. Collection of items

The buyer is responsible for removing the items. If the buyer orders a carrier to collect the purchased item, the buyer must notify the seller in advance. The seller hands over items only against payment confirmation and/or receipt. If packaging and delivery have been ordered/paid for the item, the goods will be delivered by the seller.

All successfully bid items must be removed within 7 (seven) days of the auction being confirmed, unless otherwise agreed with the seller. The seller has the right to charge rent for the square metres reserved by a successfully bid item, indoors and/or outdoors, for the period exceeding 7 (seven) days, at a reasonable daily rate. If bids are not collected within 3 (three) months, the seller reserves the right to apply the Act on the right of an entrepreneur to sell an uncollected item (15 July 1988/688).

11. Additional charges

The seller reserves the right to charge collection fees and any other additional costs and/or costs caused to a third party to the buyer.

12. Withdrawal from a bid

If the buyer withdraws from an accepted bid, with the seller's consent, the buyer must compensate the seller for the costs incurred in arranging the failed auction (27 March 1987/355 and 5 January 1994/16). The compensation fee for cancelling a binding sale is 10% of the sale price, but at least €100. The compensation fee is an amount exempt from VAT under the VAT Act.

13. Validity of the auction terms

These auction terms came into force on 17 May 2015 and replace the previously valid auction terms.
